Brett Weiss has spent over 40 years representing people and businesses in bankruptcy proceedings. His extensive experience covers all bankruptcy chapters, including complex individual and small business cases. He is known for his work in Chapter 11 restructurings, particularly under Subchapter V. Brett is Of Counsel at Frost Law and manages The Weiss Law Group, LLC.

Brett Weiss has represented people and businesses in all phases of bankruptcy for over 40 years. He has experience in complex individual Chapter 7, Chapter 11, and Chapter 13 bankruptcy cases, and in Chapter 11 small business restructuring and reorganization. Brett Weiss is the managing member of The Weiss Law Group, LLC, in Greenbelt, Maryland. He has been involved in a number of cases of first impression, including In re Maharaj, 681 F.3d 558 (4th Cir.)(the absolute priority rule in individual Chapter 11 cases); Branigan v. Bateman, 515 F.3d. 272 (4th Cir.)(§ 1328(f) applicability and time¬frames); Ford v. Roberson, 420 Md. 649 (applicability of ipso facto clauses); Hernandez v. Suburban Hospital, 319 Md. 226 (dischargeability of assignments); In re Peterson, 581 B.R. 789 (forced vesting); In re Tubman, 364 B.R. 574 (prior filing does not lift the stay as to “property of the estate”); Bunch v. Hopkins Savings Bank, 249 B.R. 667 (automatic stay and estate property); and In re Baker (No. 05-24007, Bankr. D.Md.)(venue for foreign debtors). Mr. Weiss lectures nationally on bankruptcy issues. He has spoken before the National Conference of Bankruptcy Judges, the American Bankruptcy Institute, the National Bar Association, the National Association of Chapter Thirteen Trustees, and the National Association of Consumer Bankruptcy Attorneys, among others. He has twice testified before Congress on bankruptcy and credit issues, and testified before the Bankruptcy Rules Committee and the Consumer Financial Protection Bureau. He recently served on the ABI Individual Chapter 11 Task Force, and currently serves on the Board of Directors of NACBA. Mr. Weiss is the co-author of Chapter 11 for Individual Debtors, published by Lexis-Nexis.
